So here what we need to know as home buyers!
Akta Pemajuan Perumahan(Kawalan dan Perlesenan)1966 has been amended to broaden the scope of enforcement, including projects implemented by government agencies and cooperatives, providing for quality control and project implementation on schedule and set up the Tribunal for Homebuyer Claims (Tribunal).
This provides an alternative tribunal to hear and adjudicate claims memnuntut buyer damages or compensation from the developer in a way that is easier, faster and cheaper.
Tribunal may hear any demands from homebuyers with the following conditions: -
Claims filed in the Tribunal not later than 12 months from the date of: -
Issuance of Certificate of Fitness for Occupation (CFO)
Expiration liability.
Sale and purchase agreements involving housing accommodation (house accommodation) are built on the land to a residential area.
Each claim must be not more than RM 50,000 for each clause of the action unless: -
The claimant agreed not to proceed with the remaining amount of the claim
With the consent of the developer in writing to the tribunal pendegaran.
For sale and purchase agreement (S & P) made before December 1, 2002 are also eligible provided that such claims must meet the conditions as above.
